    • Mayor Hall called to order the Regular City Council Meeting of March 1, 2022 at 6:00 PM at Surprise City Hall Council Chambers, 16000 N Civic Center Plaza, Surprise, Arizona 85374. Also in attendance with Mayor Hall were Vice Mayor Cline and Council Members: Winters, Duffy, Remley, Hastings and Judd.

      Staff Present: City Manager, Bob Wingenroth; City Attorney, Robert Wingo and City Clerk, Sherry Ann Aguilar.

    • Joe Lershan - improvements needed on pedestrian safety. Too many excessive speeders and council needs to take action, this is a serious problem. Also commented on issues with the transportation cab service.

      Linda Cabrera - Update on the community garden at Benevilla and upgrades taking place.

  • CONSENT AGENDA:
    • Vice Mayor Cline made the motion to approve the consent agenda. Council Member Hastings seconded the motion. Seven yes votes, motion carried.
  • 1. Consideration and action on the minutes of the Regular City Council Meeting of February 15, 2022 - APPROVED
  • 2. Consideration and action to approve a request for an Acquisition of Control for an existing Series 12 license (12070006311) for Macayo Restaurant located at 15565 W. Bell Road, Surprise, AZ 85374 - APPROVED
  • 3.  Consideration and action pertaining to approval of the Final Plat entitled, “Paradise 151” and dated January 13, 2022, a property generally located south of Paradise Lane between 153rd Avenue and 151st Avenue;  Case FS21-774 - APPROVED
  • 4. Consideration and action pertaining to approval of an amendment to the Fiscal Year 2022 budget by moving budget authority in the amount of $10,000 within the Grants Fund for the purpose of accepting a reallocation grant from the AZ Department of Homeland Security (UASI) for the purchase of equipment; Resolution # 2022-18 - APPROVED

Consideration and action pertaining to approval of an amendment to the Fiscal Year 2022 budget moving budget authority within grant and capital projects to/from contingency or between grant projects to adjust amounts originally estimated during the FY2021 budget process, as required by grant stipulations and guidelines, or based on anticipated revenues; Resolution # 2022-21 - APPROVED
  • 6. Consideration and action pertaining to approval of an amendment to the Fiscal Year 2022 budget by reallocating appropriations of $4,200 within the Grants Fund from Contingency to Supplies in Project G54101 in order to accept a distribution from the United States Tennis Association for the reimbursement of expenses related to growing the game of tennis; Resolution # 2022-16 - APPROVED
  • 7. Consideration and action pertaining to approval of a Fiscal Year 2022 budget amendment moving budget authority in the amount of $1,400,000 from the Police Department General Fund Personnel to Supplies/Services to support one-time operational purchases to increase efficiencies within the department, and amending the adopted FY22 Contract Awarding Authority List; Resolution #2022-20 - APPROVED
  • 8. Consideration and action pertaining to the approval of Amendment No. 1 to the Intergovernmental Agreement with Maricopa County for 2021 Home Program Funds; amending the Fiscal Year 2022 Budget by moving budget authority in the amount of $186,000 from Contingency to the Neighborhood Revitalization Fund, Project G51564; and accepting grant funding from Maricopa County via The Department of Housing and Urban Development for 2021 Home Program Funds; Resolution # 2022-17 - APPROVED
  • 9. Consideration and action pertaining to the conditional acceptance and maintenance of certain public utility improvements at the White Tanks Foothills Phase 2 development, generally located at N. White Tank Mountain Boulevard and W. Ruth Avenue; Resolution # 2022-15 - APPROVED
  • REGULAR AGENDA ITEM - PUBLIC HEARING:
  • 10. Consideration and action pertaining to approval of an amendment to the Surprise Farms PAD, rezoning approximately 11-acres from Commercial (C-2) to High Density Residential (HDR); Ordinance # 2022-06 - APPROVED
    • Vice Mayor Cline - Traffic concerns; use of commercial property and changes over the years

      Public Comment:

      Deborah and David Gentry - residents of Surprise Farms III, turned in a written statement for the record. Expressed concerns about this project, spoke in opposition. Recommended parking stickers for this complex. Youth drivers were also discussed.

      Mayor Hall asked for the developer to respond about the parking sticker.

      Wayne Donnis commented that it is a good idea and will take this into consideration.

      Mayor Hall asked if the Mark Taylor project is doing well?

      Council Member Winters made the motion to approve Ordinance 2022-06. Council Member Hastings seconded the motion. Seven yes votes, motion carried.
  • 11. Consideration and action pertaining to approval of the annexation of approximately 93.97 acres of county land, generally located south of Pinnacle Peak Road and east of 163rd Avenue; Ordinance # 2022-04 - APPROVED
    • City Planner, Trever Fleetham gave a powerpoint presentation on this item.

      Vice Mayor Cline commented that she really likes this project.

      Council Member Winters made the motion to approve Ordinance 2022-04. Vice Mayor Cline seconded the motion. Six yes votes, one absent (Remley's call dropped), motion carried.
  • 12. Consideration and action pertaining to approval of a Zone Change of approximately 24.53 acres from Rural Residential (RR) to Residential High Density (R-3) and approximately 69.44 acres from Rural Residential (RR) to Residential Low Density (R-1), located south of Pinnacle Peak Road and east of 163rd Avenue; Ordinance #2022-03 - APPROVED AS AMENDED
    • City Planner, Trever Fleetham gave a powerpoint presentation on this item.

      No public comments were made.

      Council Member Winters made the motion to approve Ordinance 2022-03. Vice Mayor Cline seconded the motion.

      City Attorney Wingo asked or clarity. Council Member Winters, is it your intent that the Ordinance being approved includes the revised stipulation A; the maximum density allowed be as permitted in the residential low density R-1 and residential high density R-3 zoning districts as stated in the Land Development Ordinance?

      Council Member Winters - Yes, that is exactly right.

      Seven yes votes, motion carried.
  • REGULAR AGENDA ITEM - NON-PUBLIC HEARING:
  • 13. Consideration and action pertaining to approval of the City Auditor Employment Agreement with Carol Holley appointing her City Auditor pursuant to Surprise Municipal Code Section 2-170 - APPROVED
    • Carol Holley gave a brief presentation on the history of her position and thanked Council for the opportunity to serve as the City Auditor and reporting to the Council.

      Council Member Judd made the motion to approve the City Auditor Employment Agreement with Carol Holley. Council Member Winters seconded the motion. Seven yes votes, motion carried.

      Vice Mayor Cline made the motion to recess the Regular City Council Meeting at 7:12 PM and enter into Executive Session. Council Member Winters seconded the motion. Seven yes votes, motion carried.

  • 1. Consideration and action to recess into executive session for discussion and consultation for legal advice with the City's Attorneys pertaining to Case No. FS20-829  pursuant to A.R.S. § 38-431.03(A)(3).
  • Adjournment
    • Council Member Winters made the motion to adjourn the Regular City Council Meeting of March 1, 2022 at 8:15 PM. Vice Mayor Cline seconded the motion. Seven yes votes, motion carried.
