    • Mayor Hall called to order the Regular City Council Meeting of April 6, 2021 at 6:00 PM at Surprise City Hall Council Chambers, 16000 N Civic Center Plaza, Surprise, Arizona 85374. Also in attendance with Mayor Hall were Vice Mayor Duffy and Council Members Hastings, Remley, Judd, Winters and Cline.

      Staff Present: City Manager, Michael Frazier; City Attorney, Robert Wingo and City Clerk, Sherry Aguilar.

  • Call To The Public
    • Aaron Bacon, a Surprise resident brought forward an idea for Boards and Commission Members. He is the Chair of the Board of Trustees, and the Vice-Chair for the Audit Committee currently as well as other organizations. I know we are scheduled to open up at the City, at the County level from the beginning have been able to meet virtually and abide by the open meeting laws. Some of the members on the boards are a little more challenged due to work schedules, if the City mimicked the County it would elevate stress, it would be a great opportunity for more volunteers, make it more convenient for everyone.

  • CONSENT AGENDA:
    • Council Member Hastings made the motion to approve the consent agenda, excluding items 5 and 12. Council Member Winters seconded the motion. Seven yes votes, motion carried.
  • 2. Consideration and action on the minutes of  the Regular City Council Work Session and Regular City Council Meeting of March 16, 2021 - APPROVED
  • 3. Consideration and action to approve a liquor license request by Andrea Lewkowitz (Agent) for a Series 12 - Restaurant license (Job #139184) for Chipotle Mexican Grill #3642, located at 16810 W. Waddell Road, Surprise, AZ 85388 - APPROVED
  • 4. Consideration and action pertaining to approval of the Master Plat entitled, “Sycamore Farms (Paradisi)” and dated February 25, 2021, an approximately 196.43 acre real property generally located on the southeast corner of Cactus Road and Cotton Lane in the Sycamore Farms PAD; Case FS20-449 - APPROVED
  • 5. Consideration and action pertaining to approval of the Final Plat entitled, “North Copper Canyon Parcel 3.3”, together with an associated Alternative Assurance Agreement, for a property generally located on the southwest corner of Pinnacle Peak Road and 183rd Avenue in the North Copper Canyon PAD; Case FS20-674 - APPROVED
    • Council Member Winters - I like the project coming in but we had some issues with the water, I am wondering if this has been straightened out.

      Lee Lambert confirmed that the issues are being addressed.

      Council Member Winters made the motion to approve Case FS20-674. Vice Mayor Duffy seconded the motion. Seven yes votes, motion carried.

  • 6. Consideration and action pertaining to approval of the Final Plat entitled, “Re-Plat of Lot 5, 'Amended Replat of Lot 3' ” an approximately 92.31 acre real property generally located south of Waddell Road and east of Loop 303. (Case FS20-665) - APPROVED 
  • 7. Consideration and action pertaining to approval of a Fiscal Year 2021 budget amendment reallocating appropriations in the amount of $200,000 for contract building inspector services; Resolution #2021-38 - APPROVED
  • 8. Consideration and action pertaining to approval of a Fiscal Year 2021 budget amendment utilizing personnel savings within the Finance Department for consulting services by moving budget authority of $50,000 from the General Fund, Full-time Salaries to Professional and Outside Services; Resolution #2021-45 - APPROVED
  • 9. Consideration and action pertaining to acceptance of a grant from the State of Arizona Department of Health Services and the Arizona Pediatric Disaster Coalition through Coyote Crisis Collaborative and approval of an amendment of the Fiscal Year 2021 budget reallocating appropriations of $8,600 within the Grants Fund; Resolution #2021-37 - APPROVED
  • 10. Consideration and action pertaining to approval of an amendment to the Fiscal Year 2021 budget by moving budget authority of $56,800 from General Contingency to AZ GOHS Project G31372 and authorizing acceptance of a grant award from the AZ Governor's Office of Highway Safety (GOHS) for overtime expenses, materials, supplies, and equipment; Resolution # 2021-40 - APPROVED
  • 11. Consideration and action declaring the City's intention to establish a lighting improvement district entitled, "City of Surprise, Arizona, SU-CottonNCactus193"  for the purpose of purchasing facilities and energy for lighting the public streets and parks pursuant to A.R.S. § 48-616; Resolution # 2021-35 - APPROVED
  • 12. Consideration and action to formally deaccession the "Give Your Community a Hand" mural - APPROVED
    • Council Member Hastings asked for clarification of the location of this item. He asked why this is being taken down as previously approved by the Arts Commission.

      Seth Dyson explained what the Arts Commission voted on and the reason why it is being removed due to deterioration.

      Council Member Hastings asked what we can do for the future making these projects last, it is tax papers money we are using.

      Mr. Dyson commented that your future plans will include maintenance plans that will cover this.

      Council Member Winters felt bad reading this that it was being removed, my handprints were on this. The whole community was involved in this project.

      Council Member Hastings made the motion to approve the "Give Your Community a Hand" mural. Council Member Winters seconded the motion. Seven yes votes, motion carried.
  • 13. Consideration and action authorizing the Mayor and Council to approve an Intergovernmental Agreement between the City of Surprise and Maricopa County Department of Transportation (MCDOT) to perform routine or emergency roadway maintenance services through the Entente Program. Resolution 2021-42 - APPROVED
  • 14. Consideration and action to enlarge an existing lighting improvement district pursuant to A.R.S. § 48-616 for the purpose of purchasing facilities and energy for lighting the public streets and parks for the SU-TieraVrdeEast185; Resolution No. 2021-39 - APPROVED
  • 15. Consideration and action pertaining to approval of an intergovernmental agreement (IGA) with other West Valley municipalities for the creation and participation in a Mobile Field Force for the purpose of providing a pool of specialized officers to be available, upon request, to assist in responding to volatile situations, incidents of civil disturbances, or events involving large crowds; Resolution #2021-18 - APPROVED
  • REGULAR AGENDA ITEM - NON-PUBLIC HEARING:
  • 16. Consideration and action finding and declaring that the continuation of a grant of a franchise to EPCOR Water Arizona Inc. is beneficial for the City of Surprise and calling a special franchise election to be held on November 2, 2021, to submit to the qualified electors of Surprise the question of whether a franchise shall be granted to EPCOR; Resolution #2021-23 - APPROVED
    • Attorney, Hobie Wingard gave a powerpoint presentation on this item.

      Council Member Cline questioned the drop in franchise fee from 2019 to 2020.

      Council Member Judd questioned what the areas are for EPCOR services.

      Mr. Lambert gave a response.

      Mayor Hall commented the agreement is straight forward, I am not happy with EPCOR right now, difficulty with Circle City Water legislation, they have not been cooperative, I am really disappointed.

      Council Member Winters made the motion to approve Resolution 2021-23. Vice Mayor Duffy seconded the motion. Six yes votes, one no vote (Hall), motion carried.

      Council Member Remley - District 4 meeting, last Wed., of this month; Tax Credit.

      Vice Mayor Duffy - Greer Ranch South HOA; Meet and Greet last week; thank you to Spencer's Place, thanked them for allowing us to hang out there.

      Council Member Cline - Meet & Greet, Sun City Grands 25 attendees; attended ZOOM Meeting with GPEC; attended Spring Training Virtual Tent Event; attended Hall of Fame at Surprise Stadium; March 27th attended birthday party for 103 year old resident; met with Brian Yoder, Dysart Unified radio programming.

      Council Member Winters - Tuesday night, State of the City virtual address; start Meet and Greet meetings again, 2nd Friday of every month; next Council Meeting, no masks.

      Council Member Judd - Boyer bakery is finally open, it's awesome! Attended the Hall of Fame ceremony, Debbie Lesko recognized Sun Dancers; ED Group put on a fantastic virtual event, fascinating; Meet and Greet several in attendance; Biosolids tour.

      Mayor Hall - Dr. Kellis up for Superintendent of the year finalist, assisted with a video supporting him. State of the City event, April 13th - 6:00 PM; Annual Wildland National Challenge; Budget Retreat on April 16th starts at 9:00 AM; Next meeting on April 20th, the Chambers will be open.
